Re: Virginia Graeme Baker Pool and Spa Safety Act 2008

The enactment of the Virginia Graeme Baker Pool and Spa Safety Act 2008 (VGBA) has made modifications and upgrades necessary to all suction outlets including existing drain boxes, attraction suction boxes, jet suction boxes and grates that cover them in order to be compliant with the new laws by December 19, 2008. At a minimum, each facility will be required to replace the grate(s) on all submerged suction outlets and assess the system for possible entrapment or entanglement issues. It is up to the pool owners to take the proper steps to resolve this issue. Failure to comply with the new code will put pools at risk of being shut down and may create huge liability issues for the owners.

Currently, there are several approved grates available on the market however the majority of them are for the smaller commercial or residential market. The manufacturers of the larger grates are nearing the completion of testing and anticipate having multiple sizes available by January of 2009. The Consumer Products Safety Commission (CPSC) has realized that it will not be possible for all pools to be in compliance with this act by the required deadline and has issued the following statement which can be viewed at www.cpsc.gov/businfo/pssaenforce.html

Patterson Pools recommends that you have your pool inspected and a solution developed by a Registered Design Professional as stated in the new code. Please be aware that there is a lot of misinformation being generated on this subject. We have thoroughly researched this new law and can assist in this process. We can also provide you with a written compliance letter from a Registered Design Professional that may be shared with your local authority or insurance provider.
